Yesterday, Pennsylvania Attorney General Kathleen Kane announced that she will refuse to carry out her legal duty to defend Pennsylvania’s Defense of Marriage Act (DOMA) from a constitutional challenge filed  by the ACLU.  That lawsuit seeks to redefine marriage in Pennsylvania, and asks a Federal judge to impose so-called “same-sex marriage” on our state.

Rather than rightfully fulfilling her responsibilities to enforce and defend duly-enacted laws in Pennsylvania, Attorney General Kane has appointed herself “judge” over our Defense of Marriage Act, stating “Pennsylvania’s DOMA has no legitimate purpose other than to disparage and injure same-sex couples by placing them in a less respected position than others.”

Really?  Promoting an institution (marriage between one man and one woman) where children have both a mother and a father isn’t a legitimate purpose?  The legislature certainly thinks it is – the General Assembly passed the DOMA with fewer than 20 voting no.

The Harrisburg Patriot-News says Attorney General Kane’s “transformation from mere prosecutor to crusader is now complete.” Therefore, citizens of Pennsylvania beware: Pro-lifers can expect that when Pennsylvania’s current and future pro-life laws are challenged in court, the AG won’t defend them. Duly enacted school choice laws will not be defended. Legitimate voter integrity laws will not be defended.

We now know that our top law enforcement officer cannot be trusted to be impartial, and not politically motivated.
