Texas Sues Pennsylvania – What’s Going On?

The state of Texas (now joined by Missouri, Arkansas, Louisiana, Mississippi, South Carolina, and Utah) filed a lawsuit with the U.S. Supreme Court against Pennsylvania, Georgia, Michigan, and Wisconsin regarding the presidential election results. Texas’ claim is that those four states ran unconstitutional elections – unlawfully enacting last-minute changes and ignoring federal and state election laws – skewing the results of the 2020 General Election. Texas filed directly with the U.S. Supreme Court as they have original jurisdiction to mediate in legal disputes between the states.

Texas’ request is that the court pause the final electoral process (the Electoral College is scheduled to vote on December 14th) and review the allegations and current litigation in Pennsylvania and the other three states. PA Republican State Senators, PA Republican State Representatives, and most of the PA GOP members of Congress filed friend of the court briefs in the case. The PA Speaker of the House Bryan Cutler (R-Lancaster) and Majority Leader Kerry Benninghoff (R-Centre) filed a brief in support of Texas’ claim – outlining that the Pennsylvania election was conducted in a manner that in no way resembled the state election laws, even the one enacted by the legislature in a bipartisan effort in 2019.
