Imagine this: You’re Mary Smith (fictitious name), one of the students in the Boyertown student privacy court case. Every time you go into the girls bathroom you wonder if whether there’s a boy in there. You have already had a personal encounter with a boy in the girl’s bathroom and when you complained you were told your school has allowed this to happen. Because of this, you’re forced to no longer use the girls locker room to change for gym class.

Should you accept that your privacy rights are subjected to how boys self-identify or is this sexual harassment and a violation of your rights?

Personal privacy is a civil right. No school district should have a policy that violates these rights.

On Thursday, May 24th at 10:00am, the case goes before a three judge panel of the U.S. Court of Appeals for the Third Circuit in Philadelphia. In August 2017, a federal judge ruled against these students from the Boyertown Area School District (Boyertown, PA), holding that girls’ right to privacy from members of the opposite sex entirely depends on how a boy identifies his own gender, and vice versa. Based on this initial ruling, if a boy identifies as a girl, other girls’ privacy rights disappear. This ruling was appealed.

Specific prayer requests:

  • Pray for the six courageous students from Boyertown that are directly involved in the lawsuit. (Mary Smith, Joel Doe, Jack Jones, Macy Roe, Chloe Johnson and James Jones – each a fictitious name used in the court case.)
  • Pray for Randall Wenger, Chief Counsel of the Independence Law Center, who will be presenting the case to the judges.
  • Pray for the entire legal team working to protect personal privacy rights on this case – including attorneys from Alliance Defending Freedom.
  • Pray for the three judges on this panel – Judge Theodore Alexander McKee, Judge Patty Shwartz and Judge Richard Lowell Nygaard.
  • Pray for a successful outcome in this case and that every students’ right to privacy will be protected.
